Why Do I Need Underinsured/Uninsured Motorist Coverage?

Florida Law only requires a driver to carry Personal Injury Protection and Property Damage coverage. This means that if you crash, no matter whose fault it is, you have a minimum of $10,000 of benefits toward medical care and $10,000 toward property damage. If you are at fault, the other party can request that your insurance cover their property damage.

It is important to note that there is no legal requirement for any driver in Florida to carry insurance that covers your medical expenses over $10,000.

The only way to protect yourself is to carry Underinsured/Uninsured Motorist Coverage. This is compensation available to you if you are injured in a crash through no fault of your own whether or not the other driver has coverage.

BUT - In order to carry this, you must also carry Bodily Injury coverage which is for another driver that you may injure (and protects you from personal liability to an extent).

UM coverage is not always guaranteed, and you will need to establish the need for the UM to trigger your ability to use it. Our experienced attorneys can walk you through that process.
